1. Official Status & Non-Affiliation Disclaimer

1.1. Private Enterprise: Ajira Aptitude is a strictly private, independent educational technology platform. We are NOT associated, affiliated, endorsed by, authorized by, or in any way officially connected with the Government of the United Republic of Tanzania, the Public Service Recruitment Secretariat (PSRS/Utumishi), or any other public or private hiring agency.

1.2. Not a Recruitment Agency: We do not offer job placement services, nor do we act as a recruitment or staffing agency. We do not facilitate employment applications, nor do we forward candidate data to employers.

1.3. No Guarantee of Employment: The use of this platform is strictly for personal cognitive skill development and examination preparation. Purchasing a subscription, completing assessments, or achieving high percentiles on our platform does NOT guarantee, assure, or imply success in actual official examinations or securing employment.

2. Account Security & Device Policy

2.1. Binding Agreement: By registering an account, accessing the Learning Hub, or undertaking any assessment on Ajira Aptitude, you enter into a legally binding contract and agree to abide by all terms listed herein.

2.2. Single-Device Protocol: Ajira Aptitude employs a strict single-device session protocol to prevent credential sharing and cheating. Logging into your account from a secondary device or browser will instantly invalidate your active session, forcefully terminate any ongoing assessment, and log you out.

2.3. Account Liability: You are entirely responsible for maintaining the confidentiality of your password and Two-Factor Authentication (2FA) codes. Any activity occurring under your account is your legal responsibility.

3. Intellectual Property Rights

3.1. Ownership: All content, including but not limited to the question banks, logic vectors, source code, user interfaces, logos, algorithms, and analytical models, is the exclusive intellectual property of Ajira Aptitude and is protected by Tanzanian and international copyright laws.

3.2. Prohibition of Reproduction: You are granted a limited, non-exclusive, non-transferable license to access the content for personal study. You may NOT copy, reproduce, screenshot, record, scrape, distribute, or commercially exploit any material from this platform. Doing so constitutes civil infringement and criminal theft of intellectual property.

4. Prohibited Conduct & Termination

Grounds for Immediate & Permanent Account Ban

Engaging in any of the following activities will trigger an automated or manual permanent ban, immediate deletion of your account, forfeiture of active subscriptions without refund, and potential legal action:

System Manipulation: Attempting to scrape, crawl, reverse-engineer, or download the question database using bots, scripts, or manual extraction methods.
Integrity Violations: Repeatedly attempting to bypass the Anti-Cheat engine (e.g., right-clicking, text-copying, or tab-switching) during timed assessments.
Fraudulent Payments: Initiating fraudulent chargebacks, manipulating Pesapal/Mobile Money payment gateways, or using stolen financial instruments.
Impersonation: Attempting to represent yourself as an employee, administrator, or affiliate of Ajira Aptitude, or any government body.
Abuse of Services: Sending abusive, threatening, or harmful content through the feedback center to our support staff.
Credential Sharing: Selling, renting, or sharing your account access with third parties.

5. Payments, Subscriptions & Refunds

5.1. Payment Processing: All financial transactions are securely processed through third-party gateways (Pesapal, Mobile Network Operators). Ajira Aptitude does not directly store your credit card or mobile money PINs.

5.2. All Sales Final (No Refunds): Due to the immediate delivery and digital nature of our intellectual property (assessments and learning materials), all payments are strictly non-refundable. Once access is granted to your account, the transaction is considered fulfilled.

5.3. Service Level Agreement (SLA): We strive for 99.9% uptime. In the rare event of a total system outage exceeding 24 continuous hours, active subscribers will be compensated with equivalent additional access days added to their account automatically. No monetary refunds will be issued for downtime.

6. Privacy & Data Protection (PDPA)

6.1. Data Collection: We operate in strict accordance with the Tanzania Personal Data Protection Act (PDPA). We collect necessary PII (Personally Identifiable Information) including your name, email, date of birth, education level, and IP address for the sole purpose of rendering services, securing your account, and generating analytical scorecards.

6.2. Third-Party Sharing: We do not sell your personal data to third parties. Data is only shared with essential service providers (e.g., payment gateways) required to execute your requests, or when legally compelled by a valid Tanzanian court order.

6.3. Right to Erasure (Right to be Forgotten): You maintain full control over your data. You may request the permanent deletion of your account and all associated performance cognitive data at any time via the Settings menu or Feedback Hub. Upon execution, this data is irrevocably wiped from our servers.

7. Limitation of Liability & Disclaimers

7.1. "As-Is" Service: The platform is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the uninterrupted availability or absolute error-free nature of the software.

7.2. Liability Cap: To the maximum extent permitted by law, Ajira Aptitude, its founders, and employees shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. In no event shall our total liability exceed the amount you paid for your most recent subscription.

8. Governing Law & Jurisdiction

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United Republic of Tanzania. Any legal disputes arising out of the use of this platform shall be subject to the exclusive jurisdiction of the courts located in Dar es Salaam, Tanzania.

By accessing Ajira Aptitude, creating an account, or remitting payment, you officially confirm that you are at least 18 years of age and have read, understood, and agreed to be legally bound by all terms, policies, and disclaimers outlined above.
